HJPC BIH – DECISION OF FIRST INSTANCE COMMISSION IN DISCIPLINARY PROCEDURE AGAINST PROSECUTOR OF BIH PROSECUTOR’S OFFICE GORDANA TADIĆ



SARAJEVO, MARCH 16 (ONASA) – The first-instance disciplinary commission of the High Judicial and Prosecutorial Council of Bosnia and Herzegovina (HJPC BiH) declared Prosecutor of the Prosecutor’s Office of BiH Gordana Tadić responsible for publishing untrue content on her profile on the social network “Facebook” and imposed a disciplinary measure on her. “Salary reduction of 30 percent for a period of 12 months”.
Namely, the defendant made a public announcement on the social network “Facebook”, using language inappropriate to the position she performs, and made, among other things, untrue allegations about the content of the conversation and the reason for the meeting between the members of the Council and the defendant and the President of the Court of Bosnia and Herzegovina, stating that on At the meeting held, Council members pressured the defendant, then the chief prosecutor, to transfer certain cases of the Prosecutor’s Office of Bosnia and Herzegovina to another prosecutor’s office, after which no disciplinary proceedings would be initiated against the defendant.
The aforementioned announcement of the defendant was transmitted by the media in the public media space, arousing the interest and comments of the public, in which way it called into question the authority and impartiality of the Council and the judiciary as a whole and violated the dignity of the judicial function.
In connection with the above, the defendant committed a disciplinary offense from Article 57, point 22 of the Law on the HJPC of Bosnia and Herzegovina, “behavior in the court or the prosecution and outside the court and the prosecution that harms the reputation of the prosecutor’s office”, so the defendant, in accordance with Article 58 and 59 of the Law on the High Judicial and Prosecutorial Council of Bosnia and Herzegovina, and in accordance with the Guidelines for determining disciplinary measures in disciplinary proceedings, for the said disciplinary offense, the disciplinary measure imposed a salary reduction of 30 percent for a period of 12 months.
There is a possibility of appealing the decision of the First Instance Disciplinary Commission to the Second Instance Disciplinary Commission of the HJPC of Bosnia and Herzegovina.
